ALTERNATIF PENYELESAIAN SENGKETA DALAM KONTRAK KERJA KONSTRUKSI

Abstract

Industri konstruksi adalah industri yang kompleks dan sulit untuk dikendalikan. Kompleks karena berhimpunnya berbagai jenis elemen konstruksi yang menuntut interaksi dari berbagai jenis keahlian dan para pihak yang terlibat di dalamnya. Sulit untuk dikendalikan karena dilaksanakan di alam terbuka yang rentan sekali dipengaruhi oleh cuaca. Halhal tersebut jika tidak disikapi dengan baik sejak dari fase awal pelaksanaan konstruksi melalui penyusunan dokumen kontrak kerja konstruksi dan manajemen pelaksanaan kontrak kerja konstruksi yang baik, dapat berpotensi menimbulkan klaim dari satu pihak yang merasa dirugikan oleh pihak lain. Klaim ini jika tidak segera diselesaikan berpotensi menimbulkan perselisihan (dispute). Meskipun dispute bukanlah sesuatu yang diharapkan dalam proses pelaksanaan konstruksi, namun seringkali harus dihadapi dan diatasi bersama oleh para pihak yang terlibat. Alternatif Penyelesaian Sengketa (APS) yang dapat ditempuh untuk menyelesaikan dispute adalah: negosiasi, mediasi, arbitrasi dan litigasi.
